DamagesDamages in civil actions refers most generally to money or other relief awarded to the prevailing party. Ordinarily, damages are compensatory in nature, and are intended to compensate or restore the claimant to a prior position. Punitive damages are additional amounts of money awarded to the plaintiff from the defendant for the purpose of punishing the defendant, and to deter other potential wrongdoers from similar bad behavior. Punitive damages are reserved for cases where the wrong committed was of an wanton and willful nature, or was intentional.
