The federal law known as the Fair Labor Standards Act
sets forth certain criteria for determining whether an employee is
entitled to certain benefits from his or her employer, such as overtime
pay. As a general rule, unless the employee is exempted from the act's
overtime provisions, overtime must be paid at the rate of one and
one-half times the regular hourly rate for any hour worked exceeding a
basic 40 hour work-week.
