Simultaneous Death Clause
information: A provision commonly found in wills whereby the testator
provides for the contingency of a death of the beneficiary coincident with the
testator, or where the order of the deaths cannot be determined. The
provisions usually mandate that the testator is to be considered to have
survived. This mandate allows the beneficiary provisions in the will to be
upheld.
